How do I treat RMDs on the Stay NJ application?

Q. Do I include my total annual RMDs from my Roth IRA on line 17c of the PAS-1 form? It says “rollovers,” not RMDs. I did not do a rollover.

A. We have a little confusion with your question.

Roth IRAs do not have Required Minimum Distributions (RMDs) for the original owner or their spouse.

A non-spouse beneficiary does not have annual RMDs until the end of the 10th year. Then they must withdraw the entire amount.

The New Jersey PAS-1 Form — the application for Stay NJ, Senior Freeze and ANCHOR, is to determine if a senior citizen is eligible for state sponsored real estate tax relief, said Bernie Kiely, a certified financial planner and certified public accountant with Kiely Capital Management in Morristown.

“When you complete NJ Form PAS-1, you must include distributions from Roth IRAs even though they are not income taxable for Federal or New Jersey purposes,” Kiely said.

“Roth IRA distributions do not constitute income for tax purposes. But they are income for the purpose of buying groceries or paying your real estate taxes,” he said. “If you had a substantial Roth IRA distribution it would be difficult to claim that you had difficulty paying your property tax.”
