Can I get unemployment and SSDI at the same time?

Q. I just applied for Social Security Disability Insurance (SSDI) and I’m collecting unemployment because of my stroke. I was let go because of my deficits. Will that be a problem?
— Out of work

A. It may be complicated.

You are able to collect both SSDI and unemployment, but the requirements for both are not compatible.

SSDI is for individuals that are disabled and cannot partake in substantial gainful activity and therefore, unable to work, said Jody D’Agostini, a certified financial planner with The Falcon Financial Group in Morristown.

On the other hand, she said, unemployment is for individuals who have lost a job through no fault of their own but are willing and able to work.

You must be actively seeking employment, she said.

“You need to report all unemployment benefits to the Social Security Administration,” D’Agostini said. “If not, it could result in overpayment or possibly penalties.”

She said New Jersey does not prohibit collecting both, but you should carefully review whether your case meets the criteria.

“It would be advisable to consult with an attorney for your specific case,” she said, noting that unemployment benefits are not considered to be earnings for Social Security purposes.
